and this is why people sue over every little thing these days. Nothing is their fault always somebody elses.

We may be living in an over-litigious time man, but a console should not be capable of destroying a disc, even if knocked over - fault is fault - the consumer should not have to bear the full brunt of a design flaw that he has no power/responsibility to control.

If you scratched the paint on your car, then had to replace the seats because the metalwork underneath was so poor it allowed immediate water-damage, the manufacturer should redress the underlying design flaw and foot the cost of the seat-replacement - the fact that lawyers and law-suits are required is simply a result of business not doing the right thing in the first place.

dont get me wrong, I actually agree with you on the xbox part. There is no reason that a console should scratch a disc.

Except that Xboxes come with a clear warning telling you not to move the console while a disc is in the tray; I think it's even on a label stuck to every new console. The instructions also warn you not to leave it in a place where it can knocked over.

It's a new console, and I hadn't gotten around to pulling out my entertainment center to set it up yet - it was just sitting on the floor, in a place where it shouldn't have been. There's nothing defective about the console, it was my fault completely.

It would be nice if the Xbox used a disc loading mechanism that holds the disc more securely; lots of disc drives use them (laptops, portable CD players), and I doubt they're very expensive. But those are usually in electronics that are meant to be moved around while they're on, which an Xbox is clearly isn't.

The game is already installed, but it can't read the disc so it doesn't know it's in the tray. If the disc isn't in the tray, it can't run off the HDD.
